3) An incentive to put in the time
Actor Tom Cruise and Katie Holmes’ had a time-sensitive prenuptial agreement including a Sunset Provision that would have nulled the prenup after the 11th year of marriage. According to the agreement, Holmes would receive $3 million for each year of marriage up to the 11th year, but if she could have made the marriage work for at least 4,016 more days, she would have been entitled to half of the actor’s extensive assets.
While no official announcement of the divorce settlement was released, according to the agreement the couple’s 5-year marriage would have given Holmes at least $15 million. Not too shabby.
Since she opted out of the marriage, claiming “religious differences,” she didn’t get a big payday but did get to keep a couple million dollars worth of purses and jewelry, including some fancy diamond earrings said to be worth $500,000. She also made sure to include $400,000 a year in child support for their daughter Suri. Tom sweetened the deal by creating a trust fund for Suri, which Katie can’t touch and Suri can access at age 18.
Media watchers say the break-up was semi-cordial since there wasn’t blatant philandering, abuse or the things that commonly ruin other relationships in the public eye. Katie reportedly told Tom she was concerned about Suri’s exposure to the world of Scientology. She was likely aware of his strong faith when the pre-nup was created, but at the time, there wasn’t a child in the picture.
